FRANCHISE REFUND POLICY

(As per Consumer Protection (Direct Selling) Rules, 2021 & Franchise Law Norms of India)

1. Objective
This Franchise Refund Policy governs the terms and conditions under which Franchise Partners of WINNFRA GLOBAL PRIVATE LIMITED (“the Company”) may request a refund for their franchise investment, deposits, or franchise kit/product purchase. The policy ensures fairness, legal compliance, and transparency as per the Consumer Protection Act, 2019, the Direct Selling Guidelines, 2016, and the Consumer Protection (Direct Selling) Rules, 2021, issued by the Government of India.

2. Eligibility for Franchise Refund
A Franchise Refund may be considered under the following conditions:

  • The franchise applicant has made a payment directly to WINNFRA GLOBAL PRIVATE LIMITED through official company banking channels.
  • The refund request is made within 30 days from the date of payment or franchise activation.
  • The franchise partner has not violated any term of the Franchise Agreement.
  • No business operations, sales, or commissions have been generated under the franchise ID.
  • The franchise kit, materials, or products provided by the company are returned in unused and saleable condition (where applicable).

3. Non-Refundable Conditions
Refunds will not be processed under the following circumstances:

  • Franchise is operational or business activity has started.
  • Franchise ID has been used to generate sales, BV, or commissions.
  • The refund request is submitted after 30 days of payment.
  • Franchisee has violated agreement clauses or misused company’s name, trademark, or property.
  • Any promotional or discounted franchise package purchased under “Non-Refundable Offer”.
  • Franchise training, events, or digital assets have already been used or accessed.

4. Refund Deduction and Legal Charges
In the event of a valid refund claim, WINNFRA GLOBAL PRIVATE LIMITED will process refunds after deducting the following applicable charges:

5. Refund Timeframe
Once the claim is verified and approved by the company, the refund will be processed according to the following timeline:
Total refund processing time: Up to 20 working days from the date of approval.

6. Refund Procedure
To initiate a refund, the franchise partner must:
Submit a written refund request to the company at helpwinnfra@gmail.com, with the subject line:
“Franchise Refund Request – [Franchise ID / Name]”

Attach the following documents:

  • Copy of Franchise Agreement / Payment Receipt / Invoice
  • Valid ID proof (Aadhaar/PAN)
  • Reason for refund
  • Bank details for refund (must match the payer’s name)
  • Return of franchise materials or products (if issued)

The company’s Franchise Compliance Department will verify all documents and transactions. Upon approval, the company will issue a Refund Confirmation Letter with the approved refund amount and expected transfer date.

7. Effect on Franchise Status
Once refund is processed:

  • The Franchise ID will be permanently deactivated.
  • All rights, benefits, commissions, BV, and privileges under that ID will cease immediately.
  • Any pending bonuses or benefits linked to the refunded franchise will be forfeited.
  • Re-application as a franchise in the future will require a fresh application and payment.

8. Dispute & Legal Jurisdiction
Any disputes, disagreements, or claims relating to this refund shall be settled amicably through internal grievance redressal first. If unresolved, the matter shall be subject to the exclusive jurisdiction of courts in [City, State], where the company’s registered office is located. This policy is governed by the laws of India and interpreted in accordance with the Consumer Protection Act, 2019 and Indian Contract Act, 1872.

9. Company Rights
The company reserves the right to reject any refund request that violates policy terms. WINNFRA GLOBAL PRIVATE LIMITED may modify, amend, or suspend this policy at any time, in accordance with legal requirements, without prior notice. Any such updates will be published on the company’s official website.
